What are the laws in MA regarding abandoning an elder parent in assisted living?
mac asked:
Her mother abandoned her as a child, putting her into foster care AFTER her father sexually abusing her. She doesn’t have a relationship with her mother but as a human being, felt badly for her and set her up in assisted living…payed a part of her rent for several years, along with medication and spending money. She no longer can afford this and has tried getting her brother involved. He wants nothing to do with his mother either, even though he is fairly wealthy. They are threatening to sue her for elder abandonment. What are her options? The home isn’t interested in working out a deal and said that they will put her out on the street. My girlfriend is really stuck at the moment and can’t even afford a lawyer. Her mother is presently at the Elisabeth Calsey House in Amesbury, MA. Any suggestions would be greatly appreciated.

Children have no legal duty to pay for care for their elderly parents. If your friend chooses to abandon her mother, she will become a ward of the state, which will place her in a nursing home as an indigent person. Bottom of the heap facility, essentially warehousing her until she dies.
It’s not a legal issue, it’s a moral one.
